Terms of Service, vlingo FIND

Thank you for choosing FIND, a service of vlingo, Inc. This document defines the terms and conditions under which vlingo authorizes you to use this service. If you do not agree to these Terms of Use, do not download or use FIND. Your downloading and continued use of this service shall constitute your acceptance of these terms of use.

Beta Status:

This version of vlingo FIND is a pre-release, beta level software program. As such, you understand and accept that the product is likely to have bugs that would not normally be found in a commercial product. vlingo makes no representation or warrantee that vlingo FIND is free of errors, bugs, service interruptions, or inaccuracies, or is reliable, accurate, complete, or otherwise valid or appropriate for any type of use.

Use FIND entirely at your own risk. You are solely responsible for any damage that results from its use, including, but not limited to, any damage to your phone or loss of data.

Lawful, Personal Purposes:

You may use FIND only for lawful, personal purposes. You must not use it for any commercial purposes.

You are responsible for compliance with all federal, state, and local law applicable to your use of vlingo FIND.

Not for Use While Driving:

Using vlingo FIND while operating any motor vehicle may be unsafe and/or illegal, and is strictly prohibited under the terms of this agreement. By downloading this application, you acknowledge and accept these terms.

Not for Emergency Use:

You acknowledge and agree that vlingo FIND neither intended nor suitable for emergency use, and that you will not use it for emergency purposes.

Content Provided by Third Parties:

vlingo FIND includes search results such as listings, maps, and related information provided by Yahoo!. vlingo makes no representations or warranties regarding the accuracy or completeness of third party information. Your use of Yahoo! content may be subject to additional terms that can be found on http://developer.yahoo.com/terms/.

Accuracy of Information:

Text and map information provided through vlingo FIND is intended for planning purposes only. Data may not be accurate due to construction, traffic, weather, accidents, companies moving locations or changing phone numbers, or other reasons.

You assume all responsibility for using data obtained from FIND.

Copyrights:

You may not delete or in any manner alter the copyright, trademark, or other proprietary rights notices appearing in map information, including photographic imagery.

Privacy Policy:

When you register and download FIND, vlingo collects your cell phone number, email address (at your option), carrier, and phone model.

When you use FIND, we collect and store your voice or text query content, and the final query that’s used for generating your requested information.

We do not collect any other personally identifiable information.

We use this information internally for (1) communicating with you about this and other vlingo products and services; (2) improving the service, particularly speech recognition accuracy; (3) gathering data pertaining to consumer adoption of carriers and phone models; and (4) other internal vlingo purposes from time to time.

vlingo never offers, sells, or otherwise discloses your personally identifiable information to any third party for any reason. Notwithstanding the above, vlingo may provide information to law enforcement agencies if so required under the law.

If you provide us with your email address and then decide you no longer wish to receive communications from vlingo, please send an email to FIND@vlingomobile.com to opt out of the notification program.

Network Charges:

FIND makes use of your carrier’s data network both to receive your queries and to serve information back to you. You may incur charges from your carrier for use of your mobile phone when you use FIND. You are solely responsible for these charges.

No Warranties or Technical Support:

FIND is provided “as is”, without any express or implied warranty or support. Vlinvlingoes no representation as to the suitability of this service for any purpose, and is not liable in any way for any consequences or damages that may arise through its download or use.

Notice:

vlingo may provide you with notices from time to time, including those regarding changes to the TOS, by but not limited to email, regular mail, SMS text message, MMS postings on the Service, or other reasonable means.

Changes and Termination of Service and Terms of Service:

vlingo reserves the right to modify or terminate the FIND service, or modify these Terms of Service, at any time without notice, for any reason and without any liability to you. Please review the current version of these terms of service from time to time to keep up to date on any changes.

Termination:

You acknowledge that vlingo FIND is a limited Beta release and that vlingo reserves the right to modify or terminate service at any time, without liability. If we terminate the service, your ability and right to use the service will both terminate at that time.
